These Terms of Service (“Terms”) govern the services provided by Thompson’s Pool Service LLC (“Company,” “we,” “our,” or “us”). By engaging our services, submitting a service request, or executing any Residential Service Agreement, Commercial Service Agreement, waiver, or addendum, you agree to these Terms.
These Terms supplement, but do not replace, any signed Service Agreement. In the event of a conflict, the executed Service Agreement controls.
These policies are incorporated by reference into any executed Service Agreement.
All services are provided on a month-to-month basis unless otherwise stated in writing. Execution of a Service Agreement authorizes ongoing service under the selected plan.
The scope of services, chemical coverage, frequency, limitations, and exclusions are governed by the Client’s selected service plan and Service Agreement.
Clients are responsible for providing safe and unobstructed access for scheduled service. The Service Agreement governs access requirements and missed service policies.
The executed Service Agreement governs billing terms, payment requirements, late fees, and enforcement. Failure to maintain valid payment or comply with billing terms may result in suspension or termination of service in accordance with the Service Agreement.
Repairs, equipment replacements, drain and refill services, specialty treatments, and other non-routine work require separate authorization before commencement. Deposits may be required before parts are ordered or labor is scheduled.
Drain and refill services require separate authorization and may be subject to additional terms, waivers, and Company policies.
Service is performed using industry-standard practices. Outcomes may vary based on environmental conditions, equipment performance, and other factors beyond the Company’s control. Detailed service limitations are defined in the Service Agreement.
The Company may document pool conditions, chemical readings, equipment status, and completed work for service verification, billing validation, quality control, and recordkeeping purposes.
All service documentation remains Company property.
Liability limitations, risk allocation, and indemnification are defined in the executed Service Agreement and any applicable waivers.
The Company reserves the right to suspend or terminate service for non-payment, unsafe working conditions, denied access, repeated policy violations, or failure to comply with the Service Agreement.
Upon suspension or termination, the Company is not responsible for pool conditions thereafter.
These Terms and any related Service Agreements are governed by the laws of the State of Arizona.
