Terms of Service

 

Terms of Service
Effective: December 16, 2024

By scheduling service, submitting payment, or otherwise engaging Thompson’s Pool Service LLC (DBA Thompson’s Pool Service), the client agrees to the following Terms of Service. These terms govern all pool maintenance, cleaning, chemical balancing, and repair services offered by the company.

1. Service Eligibility


 

1.1 Pool Condition Requirements
Routine service is provided only for pools that are:

  • Structurally sound with no major cracks, leaks, or surface damage
     
  • Equipped with properly installed and functioning pumps, filters, and plumbing capable of supporting safe circulation and chemical balance
     

1.2 Partially Functional or Problem Pools
Service may be provided to pools in disrepair if chemical levels are manageable and water circulation is intact. Additional chemical treatments and labor charges may apply.

1.3 Non-Serviceable Conditions
Thompson’s Pool Service reserves the right to delay or decline service if:

  • Structural damage poses a safety or liability risk
     
  • Equipment is improperly installed, non-standard, or non-compliant with industry norms
     
  • Repairs that the client has not approved

2. Services Provided

 

2.1 Chems+ Routine Service Model
Our standard maintenance service includes:

  • Weekly or 2–3x per month cleaning, brushing, skimming, and chemical balancing
     
  • Use of standard chemicals (liquid chlorine, acid, tabs, basic shock)
     
  • Specialty chemicals (e.g., salt, phosphate removers, enzymes, stabilizers, clarifiers, algaecides) are billed separately
     

2.2 Equipment Repairs and Installations
Our team is licensed to install and repair:

  • Pumps, filters, plumbing, chlorinators, salt cells, and water-leveling devices
     
  • Automation systems related to water flow and sanitation (excluding electrical rewiring)
     
  • Low-voltage equipment only
     

⚠️ We do not install or repair pool heaters. Heater work must be performed by licensed HVAC or electrical contractors in compliance with state law and ROC guidelines for CR-6 licensees.

2.3 Specialty Services Offered

  • Green-to-clean recovery
     
  • Drain and refill (with optional acid or chlorine wash)
     
  • Filter cleaning (cartridge or DE filters only)
     
  • One-time chemical or equipment corrections
     

2.4 Filter Cleaning Requirement
A $120 one-time filter cleaning is required before beginning service on all pools with cartridge or DE filters. This includes inspection for damage and debris removal.
Sand filters will be backwashed as needed, but sand replacement requires upgrading to an approved filter system.

2.5 Service Duration
Most routine services take 10–20 minutes, depending on the type of pool (play vs. dive) and its condition. Excessive debris, algae, or chemical imbalances may require additional time and incur extra charges.


3. Property Access

 

 

3.1 Client Responsibilities
Clients must ensure unobstructed and safe access to the pool and equipment area. This includes:

  • Functional gate codes, keys, or garage access
     
  • Clear, walkable paths free of debris, obstructions, or overgrowth
     

3.2 Missed Service Due to Access Issues
If access is unavailable at the time of visit, the service will be marked as missed and billed accordingly. A $25 rescheduling fee applies if a return visit is requested.


4. Billing & Payments

 

 

 

4.1 Monthly Billing Process
Clients must keep a valid payment method on file. All monthly service invoices are automatically processed on the 15th of each month via pre-authorization.

4.2 Late Payments and Service Holds

  • If payment is not received by the 15th, service is paused immediately
     
  • Unpaid accounts are subject to termination after 14 days
     
  • A $25 reactivation fee is applied if service resumes after a disruption
     

4.3 Repairs and Specialty Services

  • Repairs and major work require a 50% deposit before scheduling
     
  • Specialty chemical treatments or system corrections require full prepayment
     

4.4 Accepted Payment Methods
Accepted forms of payment include:

  • Credit/Debit Cards (Visa, MasterCard, AmEx)
     
  • ACH/Bank Transfers (via invoice portal)
     
  • Venmo and Zelle are no longer accepted.

5. Service Adjustments, Weather, and Emergencies

 

 

5.1 Service Rate Adjustments
Rates are reviewed annually and may be adjusted based on:

  • Seasonal demands
     
  • Rising chemical costs
     
  • Labor intensity due to neglect or client-approved delays
     

Clients will receive 30 days’ written notice before any scheduled rate change.

5.2 Inclement Weather & Natural Delays
In cases of extreme heat, heavy storms, or unsafe conditions, service may be postponed to the next available day. Priority is given to pools requiring urgent chemical correction.

5.3 Emergencies and Critical Pool Conditions
Pools with major leaks, severe chemical issues, or equipment failures will be addressed as soon as possible, based on urgency and technician availability. 


6. Client Responsibilities

 

  

6.1 Pool and Yard Cleanliness
Clients must maintain a sanitary, accessible backyard and pool area. This includes:

  • Removal of trash, excess debris, or large objects
     
  • Safe access to equipment pads
     
  • Proper cleanup of pet waste to prevent technician exposure to biohazards
     

Failure to meet site conditions may result in a skipped visit or additional cleaning fees.

6.2 Communication and Access Updates
Clients must notify Thompson’s Pool Service LLC of:

  • Access code changes
     
  • Contact or payment method updates
     
  • Major pool issues or hazards prior to scheduled service
     

6.3 Repair Approval and Neglect
Clients who ignore repair recommendations may:

  • Incur higher service costs
     
  • Experience service delays or cancellations
     
  • Assume liability for any resulting damage

7. Community and Commercial Pools

 

 

 

7.1 Scope of Work
For HOAs, apartments, and commercial facilities, Thompson’s Pool Service provides customized service plans based on pool size, usage, and compliance needs.
All work is performed in accordance with Arizona health and safety regulations for public-use water features.

7.2 Access and Point of Contact
A designated on-site or administrative contact must be available to:

  • Coordinate access and scheduling
     
  • Approve service adjustments or repairs
     
  • Manage compliance documents or permits
     

7.3 Billing and Agreements
Community pools are billed according to the agreed service frequency and contract terms. Invoicing follows the same billing structure as residential clients unless otherwise arranged in writing.

8. Documentation, Liability, and Equipment Policy

 

 

8.1 Liability Scope
Thompson’s Pool Service LLC is not responsible for:

  • Pre-existing conditions or prior contractor work
     
  • DIY installations or improperly installed systems
     
  • Losses related to denied repair recommendations
     

8.2 Equipment Standards
Only professional-grade, industry-supported equipment is installed or serviced. We do not work with off-brand, obsolete, or retail-tier DIY systems.
Clients may be required to upgrade non-compliant equipment to continue service.

8.3 Home Warranty Disclaimer
We do not coordinate, diagnose, or communicate with home warranty providers. Clients must handle all warranty claims independently.

8.4 Photos, Videos, and Privacy
We may document service with timestamped images or videos of the pool, equipment, or chemical readings. These records are stored securely for service validation and will not include identifiable photos of people.

9. Termination of Service

 

 

Thompson’s Pool Service LLC reserves the right to suspend or terminate service due to:

  • Non-payment or recurring late payments
     
  • Unsafe, unsanitary, or blocked access conditions
     
  • Refusal to approve essential repairs
     
  • Violation of any outlined terms in this agreement


10. 10. Acceptance of Terms

 

 

By receiving service, authorizing payment, or engaging Thompson’s Pool Service LLC, clients acknowledge full understanding and acceptance of this agreement. These terms may be updated at any time with reasonable notice.
