Terms of Service

 

Effective Date: December 16, 2024

Thompson’s Pool Service LLC (DBA Thompson’s Pool Service) provides professional pool services under the following terms and conditions: maintenance, cleaning, and repairs. By scheduling services, signing agreements, or making payments, clients agree to these terms.

1. Service Eligibility

 

1.1 Functional Pools Only:
Thompson's Pool Service LLC requires all pools to be:

  • Fully functional with no structural leaks, major construction damage, or improperly installed equipment.
  • Capable of sustaining water filtration, circulation, and proper chemical balance.

1.2 Non-Functional Pools:
Pools requiring repairs or renovations (e.g., deck damage, plaster/pebble issues, cracks, structural leaks) are subject to approval for service. Clients must approve recommended repairs before routine service begins.

2. Services Provided

 

Thompson's Pool Service LLC offers the following professional pool services:

  • Routine Pool Maintenance and Cleaning (weekly, bi-weekly, or customized schedules, including Airbnbs and commercial pools).
  • Specialty Services:
    • Acid Washing
    • Green-to-Cleans
    • Drains and Refills
    • Filter Cleans (cartridge and DE filters only).
  • Repairs: Installation of pool pumps, lights, heaters, automation systems, and related equipment.

2.1 Filter Cleaning:

  • At the start of service, a one-time $120 filter cleaning fee is required for pools with cartridge or DE filters.
  • Sand filters will be backwashed as part of routine service. If sand replacement is required, clients must upgrade to a recommended cartridge or DE filter at their expense.

2.2 Specialty Chemicals:

  • Routine chemicals are included in service rates.
  • Specialty chemicals (e.g., phosphate removers, enzyme treatments) are charged separately. Salt pools require initial salt additions, which are billed to the client.


3. Service Access

 

3.1 Client Responsibility:
Clients must provide proper access to the pool, including:

  • Gate codes, keys, or garage keypads.
  • Safe access pathways to equipment and the pool area.

3.2 Interruptions Due to Access:
Failure to provide access on scheduled service days will incur charges for the missed visit.


4. Payment Terms

 

4.1 Payment Due Date:

  • Payments for ongoing monthly services are due by the 15th of each month.
  • Late Fees: A late fee will apply if payment is not received by the 15th. Failure to pay within two weeks may result in service cancellation.

4.2 Reinstatement of Service:
If clients wish to reinstate service after cancellation due to non-payment, they must:

  • Pay outstanding balances, including applicable late fees.
  • Not promptly notify Thompson's Pool Service LLC of any payment delays to avoid interruption.

4.3 Accepted Payment Methods:
We accept the following forms of payment:

  • Credit Card/Debit Card
  • Bank Transfers
  • Venmo or Zelle

4.4 Upfront Costs:

  • Initial service requiring specialty chemicals, salt additions, or significant adjustments must be paid in advance.


5. Service Adjustments and Rate Changes

 

5.1 Annual and Periodic Adjustments:
Rates are subject to change annually or as needed, with a 30-day notice provided to clients.

5.2 Seasonal Adjustments:
Chemical usage and pool demands vary seasonally. Adjustments to service rates may occur if:

  • Water quality requires additional specialty chemicals.
  • Equipment maintenance becomes necessary due to neglected repairs or recommendations.

6. Weather and Emergencies

 

6.1 Inclement Weather:
In cases of inclement weather where service is unsafe, or visibility is compromised:

  • Service may be rescheduled to the following day.
  • Clients are asked for patience while we prioritize pools requiring immediate attention.

6.2 Emergency Situations:
Pools experiencing critical issues (e.g., broken lines, major leaks) will be prioritized based on urgency and client availability.



7. Client Responsibilities

 

7.1 Pool Condition:
Clients are responsible for maintaining their pools in serviceable condition. Failure to approve repairs or upgrades may result in interrupted service or rate changes.

7.2 Neglect of Recommendations:
Clients who disregard repair or maintenance recommendations assume liability for resulting damages, additional costs, or interrupted services.

7.3 Proper Communication:
Clients must notify Thompson’s Pool Service LLC of any changes to access points, payment methods, or service concerns.

8. Documentation and Privacy

 

8.1 Service Documentation:
Thompson's Pool Service LLC will document pool conditions with photos and videos, time-stamped for service verification.

  • Images may include pool equipment, pool areas, pets, or other relevant features.
  • Personal images of people or children will not be taken.

8.2 Privacy:
All client information, including photos and access details, is stored securely and used solely for service purposes.



9. Liability and Warranties

 

9.1 Scope of Responsibility:
Thompson's Pool Service is responsible only for our team's work.

  • We are not liable for pre-existing equipment failures, structural issues, or repairs performed by third parties, including home warranty providers.

9.2 Home Warranty Disclaimer:

  • Thompson's Pool Service LLC does not diagnose, service, or coordinate with home warranty companies.
  • Clients must manage all home warranty claims independently.

 9.3 Approved Equipment Standards:
Thompson's Pool Service LLC installs, services, and recommends only professional-grade, industry-standard equipment proven reliable, durable, and widely supported by pool professionals. We do not work with off-brand, outdated, or non-standard equipment, including equipment sourced from retailers primarily catering to DIY homeowners. Clients must upgrade to approved equipment to ensure safe and effective pool operation. 


10. Termination of Service

 

10.1 Grounds for Termination:
Service may be terminated for the following reasons:

  • Failure to maintain payment compliance.
  • Continued neglect of repair recommendations or poor pool conditions.
  • Breach of these terms or refusal to provide proper access.

11. Acceptance of Terms

 

By engaging Thompson’s Pool Service LLC, scheduling services, or making payments, clients acknowledge and agree to these Terms of Service.
